This is an attempted-burglary case. On August 1, 1967, an information was filed in the circuit court for Milwaukee county, charging Donald Bethards (plaintiff in error, hereinafter referred to as defendant), and John Watkins with attempting to burglarize the Port Bar in Milwaukee, in violation of secs. 939.32 (attempt) and 943.10 (1) (a) (burglary), Stats. Defendant entered a not guilty plea and after Watkins case had been severed, the defendants jury trial began on February 21, 1968.
